Pricing the lawyer’s service is talking about the design of the offer. Talking about supply is talking about demand. In more detail, in the corporate world, first of all, it is required for the subject, albeit cautiously, to grasp basic concepts of the corporate world.
The company is based on an initial business plan, whose elements are mission, vision, strategy, goal, objective and control. The legal service provider must be aware of both this planning and the macro and micro-behaviours of the economy.
It is known, for example, in Brazil, according to the country survey 2014 and 2018, that is, before the period of Pandemic 2014 and 2018, period of Pandemic 2020, that there were more company closures than openings. About 382,500 companies closed their activities for some reason. On the other hand, the volume of profits measured by Brazilian companies abroad hit a record in 2021, according to information from the Central Bank of Brazil, specifically in September 2021. And that, according to CBInsights, Brazil has significant participation in the creation of unicorns, which can be defined as startups that have reached in terms business value above 1 billion dollars.
These data prove the heterogeneity of the market which, in turn, although in theory, states: the same service can vary depending on the size and specificity of the demand/client.
The client company planned the deal. For this, a constant management process is necessary since its foundation and that continue in the vision of conducting the company’s activities or business.
It is an effort that includes planning, executing and controlling the entity’s activities.
An ideal management model that includes the potential legal causes is expected. A good solution to legal demands entails a good assessment of the performance of the areas and managers (responsibility for the results of the areas under their command); it signals the company’s care for the group’s name and, therefore, the zeal has a positive impact on the company’s relationship with the workers involved.
And, from an eminently legal point of view, a law firm, service provider, must consider such ideas when dealing with the client. The firm must be aware that the client’s hiring of a lawyer, in theory, is part of the materialization of the company’s full business. It doesn’t escape statistics. And that the service offer must be considered in the matrix and the company’s attendance. This mainly impacts when negotiating and setting the price for the legal services to be provided.
As is well known, there is a regulation by the Bar Association. Despite tracing maximum and minimum parameters, it does not set an unmoved equation for such a definition.
It is a mistake, therefore, to think that the law firm has a fixed and unshakable reference to provide the pricing of its services.
Pricing the service of the law firm is to be subject to the demand-supply aspects, concerning the regulations that the subject involves.
